You and Wing Snob agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or mass action proceeding.

13.3 Class Action Waiver

YOU AND WING SNOB EXPRESSLY WAIVE THE RIGHT TO TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. Any arbitration or other legal proceeding shall be conducted on an individual basis only. If this class action waiver is found to be unenforceable in whole or in part, then the entirety of this arbitration provision shall be null and void, and the Dispute shall be resolved in a court of competent jurisdiction.

13.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
